Cancellation of Your Booking by You Prior to Your Tenancy Start Date (No Place No Pay Guarantee) 6.1. Mys Living offers a guarantee that if you do not take up your place at your chosen University, you may be released from your Booking and your obligations under the Tenancy Agreement, subject to the following conditions being met: a) You are unsuccessful in gaining a place at your chosen University due to failure to obtain the required grades; b) You are unsuccessful in obtaining a required visa to study at your chosen University; c) Written evidence of the relevant outcome (for example, an official letter or email from the University or placement provider) is provided within 5 days of you receiving it; and d) Your cancellation request is reviewed and formally accepted by Mys Living, confirming that your liability under the Tenancy Agreement has been lifted. 6.1.2 In such cases, your Holding Deposit will be refunded in accordance with our refunds policy. 6.1.3 Where Mys Living cannot verify the authenticity of the evidence provided, we reserve the right to reject the request and enforce the terms and conditions of the Tenancy Agreement in full. 6.1.4 If you wish to cancel your Booking for any reason not listed above, or if your request is not accepted by us, you will remain responsible for all terms and conditions of the Tenancy Agreement. 6.1.5 In certain circumstances, it may be possible to find a replacement tenant to take over your agreement obligations. This will be managed in accordance with the Mys Living tenancy assignment policy.

Requests to Cancel Your Tenancy After the Tenancy Start Date 7.1. Where your Tenancy Start Date has passed and/or you have collected keys for the property, you may only terminate your Tenancy Agreement with Mys Living in the following circumstances: a) You no longer continue to be a student at your chosen University as a result of a medical condition which was not known to you at the time of commencing your tenancy; or b) You no longer continue to be a student at your chosen University as a result of a family bereavement or circumstance which was not reasonably known to you at the time of commencing your tenancy. 7.2. In these circumstances you should make a request to the General Manager of your building in writing (via email) and include evidence of your stated reason(s) and your withdrawal from University. 7.3. All documentation and attachments must be received by us in English in order for us to consider your release from tenancy. 7.4. Upon acceptance, your tenancy release will be valid from the date two (2) weeks after the approval has been submitted to us or two (2) weeks after your release date from University, whichever is the latest. 7.5. Submission of a request and associated documentation is not a guarantee that your tenancy release will be approved and you will remain responsible for the terms and conditions of the Tenancy Agreement in full until the date your release becomes valid. 7.6. In all circumstances a replacement tenant may be identified to take over your tenancy provided such replacement is in accordance with the Mys Living tenancy assignment policy.
